Metal Gear Solid Avoided A Lawsuit Because John Carpenter Likes Hideo Kojima

People sue people all the time in Hollywood, sometimes over things that make sense and sometimes over things that don’t. One of the more recent lawsuits involved legendary director John Carpenter getting a piece of the pie from a lawsuit over the Luc Besson film, Lockout, since it was basically a ripoff of Escape From New York City. The company heading up the lawsuit always wanted to go after Konami and director Hideo Kojima over Metal Gear Solid, but filmmaker John Carpenter forbade it.

Niche Gamer picked up the news from an silly interview on The Hollywood Reporter where they failed to ask a lot of important follow-up questions. They noted that CanalPlus had managed to win a settlement suit against Besson and the production company over the low-budget action flick Lockout for ripping off of Escape From New York City, netting them only €80,000. According to Carpenter…

“CanalPlus is the company that, with me, owns Escape From New York. They came to me and said, “Luc Besson ripped you off on Lockout.” Or Lockdown, whatever the hell that was. And they sent me the movie, and yes, he did. It’s the same story. (Laughs) I mean, you can’t do that, can you? You have to change a couple things. He’s after the president’s daughter? Come on. So I took him to French court.”

 

“[…] [Besson] has another company. But I think they’re actually doing some business with him, too. [CanalPlus] wanted to also go after the video game Metal Gear Solid, which is kind of a rip-off of Escape From New York, too, but I told them not to do that. I know the director of those games, and he’s a nice guy, or at least he’s nice to me.”

The interview is kind of bizarre. Carpenter repeatedly mentions that no one talks to him about anything that goes on in Hollywood, whether it’s regarding his movies, remakes or lawsuits. However, as mentioned, apparently Hideo Kojima does or did talk to him and was nice about the influences that Carpenter’s movie legacy had on the Metal Gear Solid franchise.

For those unfamiliar, the lead character, Snake, is based both visually and thematically on Snake Plissken from the Escape From New York and Escape From LA movies, a role made famous by the incomparable Kurt Russell.

Carpenter later mentions in the interview that he just likes to sit and watch basketball on television and play video games. The person conducting the interview failed to even ask “What video games do you play?”

Epic. Fail.

    John Carpenter does seem kind of distant. I remember Rob Zombie telling a story about how he was trying to get Carpenter’s blessing to make a Halloween remake. Zombie eventually got a hold of Carpenter and Carpenter couldn’t have cared less.

    But Carpenter is, without a doubt, a film making legend. And his music is awesome.

      That is so awesome! He genuinely seemed enthused about gaming.

      I also agree with you about his awesome music. I love his soundtracks, I watch his movies rather frequently and The Thing, Escape From New York City and They Live rank up there as some of the best films I’ve ever seen. Yeah they’re low-budget and schlocky but they’ve got great lighting, awesome action and the heroes aren’t afraid to shoot first and ask later!

    This is somewhat ironic when considering that Konami owns the MGS IP. IIRC Konami is one of the JP companies that’s very anal about their IPs.

    If only more people weren’t so anal about protecting their IP. If it’s outright plagiarism with zero respect/appreciation for the original creators, then that’s bad. Otherwise, people should be a bit more lenient. And this is coming from someone who has been plagiarised many, many times throughout their life.

    When I imagine how many potentially incredible works of art have already been shutdown because they infringed IP in some way, it makes me sad. That’s why I have great respect for Japan’s doujin stuff. Many Japanese companies seem to let fans do all sorts of things, and I think that’s great. It’s more of a creator fan relationship, instead of simply creator -> fan.

    On a related topic, I recently saw a character design I really liked, and would like to have a similar-looking character for one of my game concepts, but I worry about what crosses the line in terms of plagiarism and copyright. If the
    hairstyle is too similar, would people notice and get upset? What if the accessories are similar and worn in the same places? If the design is perfect as it is now, would changing it simply result in an inferior imitation? Etc, etc.

    We’re all humans living living in the same world, inspiring/influencing each other, and we fundamentally share similar/identical ideas, etc. For example, there are a bunch of things like some concepts/myths/legends that are virtually identical in different isolated cultures.

    There are only so many things in the world, so there will always be similar stuff, whether we like it or not. Especially moreso now that we have the internet, and that much of the world has been globalized. I think it’s also very much a matter of time and place. Wait a hundred years or so, and regurgitate someone else’s creation. Would people even remember to sue for infringement?

    I don’t get how MGS is anything like anything Carpenter has ever done. But anyway, it has been common knowledge that Carpenter loves video games for a long time. In fact, in 2013 and 2014, he did a “top 5/6 games of the year” list on GiantBomb:
